                                                                 Theft

       Theft is committed when a person unlawfully seizes the property of another
person with the intention to deprive them of that property. It may also involve
taking possession of someone else’s property when it has been entrusted to the
person for a limited period of time or if they had any knowledge that the property
was stolen from someone else.

       It is unlawful to receive property or services that rightfully belong to another
person by not fully disclosing the truth. It is additionally illegal to claim property as
one’s own, even if it was received by mistake.  Service theft is applicable when a
person receives services which must be paid for, but does not pay for them. Lastly,
theft can also be committed by unlawfully taking someone else’s property if they are
in a vulnerable situation (i.e. sickness, disability or other circumstance in which they
are fully capacitated).

       Theft, is not committed, if the property was a gift and the alleged victim had a
habit of giving similar gifts before becoming vulnerable or if the transaction had
already been approved by the superior court.
